NittanyTaxi - Terms of Use

These Terms of Use ("Terms") govern your access to and use of the NittanyTaxi mobile applications, website, and services (collectively, the “Service”) operated by NittanyTaxi (“we,” “us,” “our”). By accessing or using the Service, you agree to comply with and be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
1. Definitions
• “Service” refers to all features and functions offered by NittanyTaxi, including vehicle dispatching, booking, route planning, and rider communications through our mobile app, website, or by phone.
• “User” refers to anyone who uses the NittanyTaxi service, whether as a passenger or a company-authorized driver.
• “Driver” refers to NittanyTaxi-employed or company-authorized drivers operating NittanyTaxi vehicles
The information Phone Numbers obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
2. Eligibility and Account Creation
You must be at least 18 years old to create an account or use the Service. You are responsible for ensuring that the information you provide is accurate and up to date.

NittanyTaxi provides licensed transportation services through company-owned or companyauthorized vehicles operated by NittanyTaxi-employed drivers. Ride requests may be made through our app, website.
4. Rider and Driver Responsibilities
4.1 Riders Must:
• Provide accurate pickup and drop-off information
• Maintain respectful and safe conduct during rides
• Pay for all trips and applicable fees promptly

• Be authorized and trained by NittanyTaxi.
• Hold a valid driver’s license and comply with all local transportation laws.
• Operate vehicles safely and follow assigned route instructions.
5. Payments and Fees
Riders agree to pay all charges for rides requested through the Service. Charges may include:
• Base fare
• Distance/time-based fees
• Applicable taxes and surcharges
• Cancellation or no-show fees
All payments are processed securely through third-party providers (e.g., Stripe). NittanyTaxi does not store credit card information.
6. Cancellations and Refunds
Riders may cancel a ride request at no cost within a limited window after requesting a ride. Fees may apply for late cancellations or no-shows.
Refunds, if applicable, are issued at our sole discretion and may take several business days to process.

You agree not to:
• Engage in fraudulent activity or impersonation
• Harass or harm other users
• Use the platform for illegal purposes or to transport prohibited items
• Interfere with the platform’s operations or security
Violation of this section may result in immediate suspension or legal action.
8- Standard Messaging Disclosures:
8.1 The NittanyTaxi platform and transportation services are provided “as is” and “as available.” While we strive to offer timely and reliable service, we make no guarantees regarding uninterrupted access to the platform or the availability of vehicles at all times.
8.2 To the fullest extent permitted by law, NittanyTaxi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our platform or services. This includes, but is not limited to, delays, missed appointments, system outages, or other non-physical losses.
8.3 NittanyTaxi is not liable for delays or service interruptions caused by factors beyond our control, such as traffic congestion, weather conditions, road closures, or unforeseen operational disruptions.
9. Indemnification
You agree to indemnify and hold harmless NittanyTaxi, its affiliates, and employees from any claims, losses, damages, or expenses arising from your:
• Use of the Service

• Negligence or misconduct
10. Changes to Terms
We reserve the right to modify these Terms at any time. Updates will be posted on this page with a revised "Last Updated" date. Continued use of the Service after changes means you accept the updated Terms.
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

Appendix A – SMS Terms & Conditions
1. Consent for SMS Messaging
By providing your phone number, you consent to receive SMS messages from NittanyTaxi for the following purposes:
• Ride confirmations and status updates
• Appointment reminders
• Billing notifications
• Follow-up messages and service alerts
2. Message Frequency
Message frequency may vary depending on ride activity. You may receive up to 4 messages per week, but actual frequency depends on your usage.
3. Message & Data Rates
Standard message and data rates may apply according to your carrier plan. Charges may differ for domestic vs. international messaging.
4. Opt-In and Opt-Out
You can opt in by:
• Checking a consent box during account creation
• Submitting your phone number through the app or website
You can opt out at any time by:
• Replying "STOP" to any NittanyTaxi SMS
